Section 3
License Grant
nTrader provides a limited, revocable, non exclusive and non transferable right to install and use the Desktop Application only for accessing services made available by the user’s Financial Service Provider (FSP) through supported terminal interface connectivity.
The software is provided under licence; ownership of the software is not transferred to the user.
Section 4
Nature of the Software
nTrader acts as a software technology provider, SaaS vendor and terminal interface provider. The Desktop Application may carry the branding of an authorised financial institution, and any displayed server identity relates to that institution’s infrastructure rather than infrastructure operated by nTrader.
- nTrader does not operate as a financial broker.
- nTrader does not provide financial services or investment advice.
- nTrader does not open or administer financial accounts.
- nTrader does not hold or safeguard client funds.
- nTrader does not execute financial transactions on the user’s behalf.
Section 5
Financial Services Relationship
Financial services accessed through the software are supplied independently by the user’s authorised FSP. The customer relationship, financial agreements and service obligations exist between the user and that FSP; nTrader is not a party to those financial service arrangements.
Section 6
Financial Infrastructure
Financial accounts reached through the Desktop Application are hosted and maintained by the relevant FSP. nTrader does not operate the FSP’s trading servers, control its account infrastructure, hold customer assets, or direct trading execution.
Section 7
No Financial Advice
The Desktop Application is a software interface and does not provide investment, financial, tax or legal advice. Market information or analytical displays are presented for interface functionality and should not be treated as advice.
Section 8
Account Access Limitations
The Desktop Application is intended to connect only to an already existing FSP account.
- The Desktop Application does not create financial accounts.
- It does not process deposits or withdrawals.
- It does not sell financial products.
- It does not perform client onboarding for the FSP.
Section 9
Regulatory Responsibility
Licensing, regulatory and compliance duties associated with financial services remain the responsibility of the relevant authorised FSP. nTrader’s role is limited to supplying software technology.
Section 10
Geographic Restrictions
Access to the software may be limited or unavailable in particular territories when required by legal, regulatory or operational considerations.
Section 11
User Responsibilities
Users are expected to use the Desktop Application lawfully and responsibly.
- Comply with applicable agreements and requirements of the FSP.
- Keep login details and other credentials confidential.
- Maintain reasonable security of the device and operating environment used to access the software.
Section 12
Data Protection and Privacy
Use of the Desktop Application is also subject to the nTrader Privacy Policy and the applicable data handling terms made available by nTrader.
Section 13
Complaint Handling and Escalation
nTrader is not a financial dispute resolution authority, arbitrator or mediator. A complaint concerning an FSP may be forwarded to the appropriate institution for handling.
- Initial forwarding is generally targeted within about one business day.
- If no response is received, a first reminder may be sent after about five business days.
- A further escalation may follow after another five business days, with an additional notice period where applicable.
nTrader does not investigate the merits of a financial dispute or determine financial liability.
Section 14
Relationship Confirmation
- The financial relationship is between the user and the FSP.
- Using nTrader does not create a financial services relationship between the user and nTrader.
- nTrader supplies software interface access only.
Section 15
Intellectual Property
All rights in the nTrader software, source code, trademarks and related intellectual property remain with nTrader or its applicable rights holders. The licence granted to the user does not transfer those rights.
Section 16
Limitation of Liability
To the extent allowed by applicable law and subject to the complete governing terms, nTrader does not assume responsibility for losses arising from trading outcomes, financial losses, failures of an FSP’s systems, market events, or acts and omissions of financial institutions.
Section 17
Termination
Access to the Desktop Application may be suspended or terminated where required by law, by applicable contractual obligations, or when these terms are breached.
Section 18
Updates
nTrader may update the Desktop Application or revise this EULA from time to time. Users should review the current version made available through official nTrader channels.
Section 19
Governing Law
The EULA is governed by the laws of the United Arab Emirates, subject to any mandatory legal rules that apply to the user.
Section 20
Platform Distribution and Third Party Store Disclaimer
Where the application is obtained through a third party application store, the store operator is not responsible for nTrader’s application, its maintenance, technical support, operation or content. nTrader remains responsible for its software maintenance and support only within the scope stated in the applicable EULA.
Any financial service or financial dispute continues to be solely between the end user and the relevant FSP. nTrader does not recommend a particular FSP; users are responsible for checking the licensing and regulatory standing of any provider they choose.
